Terms of Use

Nyumbani is a listings and introduction platform. We help house hunters find rental properties, and we help landlords and property agencies ("property partners") list units and connect with prospective tenants.

Nyumbani is not a landlord, letting agent, or party to any tenancy. Creating an account, saving a property, requesting a viewing, or messaging a property partner through the Service does not create a tenancy, lease, or any binding agreement between you and Nyumbani. Any tenancy is a private agreement between the house hunter and the property partner, and Nyumbani is not responsible for its terms, performance, or outcome.

You need an account to use most of the Service. When you sign up you choose a role — house hunter or landlord/agency — and the features available to you depend on that role. You must provide accurate information when creating your account and keep it up to date.

You are responsible for all activity on your account and for keeping your login credentials secure. Tell us right away at [email protected] if you suspect unauthorized use of your account.

You must be at least 18 years old to create an account and use the Service.

Property partners are responsible for the accuracy of the listings they submit, including descriptions, pricing, availability, amenities, and images. Nyumbani reviews listings before marking them "verified," but a verified badge is not a guarantee — it reflects our review process at a point in time, not an ongoing inspection or endorsement of the property or the property partner.

House hunters should independently confirm a listing's details, view the property in person or via a scheduled viewing, and exercise their own judgment before making any payment or agreement with a property partner.

We may remove, suspend, or decline to verify any listing at our discretion, including for inaccurate information, suspected fraud, or violation of these Terms.

The Service lets house hunters request viewings and property partners accept, reschedule, or decline them. Nyumbani facilitates the scheduling only — we are not present at viewings and are not responsible for what happens during them. Meet in safe, public-facing circumstances where possible, and use your own judgment about who you meet and where.

Listing a property on Nyumbani is currently free for landlords and agencies — no subscription fee applies, and listed properties are not hidden from search because of payment. We may introduce fees in the future and will give notice before any new fee applies to you.

Viewing fee. House hunters can request a viewing for free. Once the landlord confirms it, the house hunter pays a viewing fee of KSh 400 by M-Pesa to secure the viewing. Until the fee is paid, Nyumbani's own contact number is shown instead of the landlord's; the landlord's contact details are shared after payment. The fee is refunded in full if the landlord cancels the confirmed viewing, or if, when you arrive for a confirmed viewing, the property is no longer available. Refunds are sent to the M-Pesa number used to pay the fee. Otherwise the viewing fee is non-refundable.

Payments are processed via M-Pesa. By initiating a payment you authorize the charge to the phone number you provide, and you confirm that you are authorized to use that phone number for payment. Fees are quoted in Kenyan Shillings (KES) and, once successfully processed, are non-refundable except where required by law or expressly stated otherwise.

We are not responsible for delays or failures caused by Safaricom, your mobile network, or your device. If a payment is deducted but not reflected in your account after a reasonable time, contact [email protected] with your M-Pesa confirmation details.

You agree not to:

• Post false, misleading, or fraudulent listings or reviews;
• Impersonate another person, business, or property partner, or misrepresent your role, ownership, or authority over a property;
• Use the Service to harass, discriminate against, or scam another user;
• Scrape, copy, or republish listings or user data from the Service without our written permission;
• Attempt to bypass account roles, verification checks, payment requirements, or any access control within the Service;
• Upload content that infringes someone else's intellectual property or violates applicable law.

We may suspend or terminate accounts that violate this section, with or without notice, and may report suspected fraud to the relevant authorities.

You retain ownership of the listings, images, messages, and other content you submit to Nyumbani. By submitting content, you grant Nyumbani a non-exclusive, royalty-free license to host, display, and distribute it on the Service and in related promotional materials, for as long as your content remains on the platform.

You are solely responsible for content you submit and confirm you have the rights necessary to share it (for example, the right to use and display property images).

The Service includes an AI Assistant that can search listings and answer questions using information available on the platform. Responses are generated automatically and may be incomplete or inaccurate. The AI Assistant does not replace independently verifying a listing, its availability, or its price directly with the property partner.

The Service is provided "as is" and "as available." To the fullest extent permitted by law, Nyumbani makes no warranties, express or implied, about the accuracy of listings, the conduct of users, the availability of the Service, or that the Service will be uninterrupted or error-free.

To the fullest extent permitted by law, Nyumbani and its operators are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including disputes, losses, or damages arising from a tenancy, viewing, or transaction between a house hunter and a property partner. Nothing in these Terms limits liability that cannot be limited under Kenyan law.

You may stop using the Service and close your account at any time by contacting us. We may suspend or terminate your access to the Service, in whole or in part, if you violate these Terms or if we reasonably believe doing so is necessary to protect the Service or other users.

We may update these Terms as the Service grows. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify users through the Service. Continued use of the Service after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of Kenya. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Kenya.
